فاعلية نظام المسؤولية الدولية لردع المنتهكين وإصلاح الأضرار البيئية.

Résumé: الملخص : تهدف هذه الدراسة إلى تبيان أهم العناصر التي تقوم عليها المسؤولية الدولية عن الأضرار البيئية، وذلك باعتبار أن المسؤولية الدولية هي الإطار العام التي يقوم عليه القانون الدولي، والذي يترتب على المخالفة القانونية التي تلحق بالبيئة. كما تقوم المسؤولية الدولية بمجود توفر الأركان الأساسية، حيث تستهدف العقاب على كل من أخل بالتزاماته البيئية . كما تم تناول في ظل هذا الموضوع الأسس التي تقوم عليها المسؤولية الدولية عن الأضرار البيئية، سواء أكانت مفاهيم حديثة أو تقليدية، إلا أنه نجد أن الهدف واحد وهو توقيع العقاب على الغير ملتزمين بالأحكام القانونية الدولية بالبيئة الكلمات المفتاحية : البيئة – المسؤولية الدولية – الضرر البيئي – مبدأ الملوث الدافع . Abstract: This study aims at demonstrating the most vital elements of the international liability for the ecological damages, since the international liability is the general framework of the International Law, which is the result of legal offences against environment. The international liability also must impose sanctions on everyone infringes his environmental commitments. In the light of this topic, the basis of international liability for the ecological damages are also addressed, either the concepts are modern or traditional, the aim is to impose sanctions on the noncompliant with the International Law provisions of environment.
