Résumé: تعد الحصانة البرلمانية من الضمانات الأساسية لاستقلال نواب البرلمان عند أدائهم لمهامهم النيابية، لذلك نصت دساتير الدول عموما و منها الدستورين الجزائري و المصري على نوعين من الحصانة، حصانة موضوعية و أخرى إجرائية، و الدراسة المقارنة في هذا الموضوع تعتمد على إبراز العناصر الجوهرية التي تدعم إحدى الفرضيتين المطروحتين كأساس لإشكالية هذا الموضوع، و المتمثلة فيما إذا كانت هذه الحصانة هي امتياز، أم هي ضمانة لصالح عضو البرلمان. و هو ما ينعكس مباشرة على مدى استقلالية السلطة التشريعية ضمن التطبيق الفعلي لمبدأ الفصل بين السلطات في الدولتين محل الدراسة، و قد كان للثورة الشعبية في دولة مصر و الحراك الشعبي في دولة الجزائر أثر واضح في الرفع من سقف الطلبات المقدمة للبرلمان، و المتعلقة بتفعيل إجراءات رفع الحصانة البرلمانية عن أعضائه و الحصول على إذن البرلمان لفتح المجال أمام القضاء من أجل متابعتهم. Parliamentary immunity is a basic guarantee for the independence of MP’s in the performance of their parliamentary duties. Therefore, the constitutions of the states in general, including the Algerian and Egyptian constitutions, provided for two types of immunity, substantive immunity and procedural immunity, one of the two hypotheses put forward as basis for the problem of our subject, whether this immunity is a privilege or is it a guarantee in favor of the parliamentarian. this is reflected in the independence of the legislature and the principle of separation of powers in the two countries, the revolution in Egypt and the popular movement in Algeria have had a clear effect in raising the ceiling of applications submitted to the parliament, concerning activating the procedures of lifting parliamentary immunity from its members, To open the way for the judiciary to follow up.
