الإشكالات القانونية و العملية لعقد الشراكة الفلاحية

Résumé: الملخص: يعتبر العقار الفلاحي مصدرا للثروة، و جزءا من ديناميكية و حركية الاقتصاد الوطني و مرتبط بالواقع الاقتصادي و الاجتماعي للدولة، مما جعله سببا لاهتمامها المتنامي، و توجهها الجدي نحو الاستثمار فيه، و ترجم ذلك في منظومة قانونية متنوعة لحمايته، و تطويره .آخرها القانون 10/03 المتعلق بكيفيات و شروط استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة فكان الامتياز الآلية و الصيغة الجديدة التي كرسها المشرع بموجب هذا القانون و بالنتيجة استحدث عقود الشراكة الفلاحية كخطوة و تجربة جديدة لتمويل المستثمرات الفلاحية بعيدا عن دعم الدولة و تدخلها بهدف زيادة القدرة الإنتاجية لهذه المستثمرات، و تطوير القطاع الفلاحي . لكن هل نجح المشرع عبر هذه الآلية و بمقتضى النصوص القانونية المنظمة لها في تحقيق الأهداف المرجوة أم أصبحت عقود الشراكة هاجس كبح عجلة الاستثمار في القطاع الفلاحي و أثر سلبا على مردودية القطاع و هذا ما سنحلله في المقال أدناه . Abstract: Agricultural real estate is considered a source of wealth and an integral part of the national economy. It is closely linked to the economic and social reality of the country, driving continuous interest and investment efforts. The legal system overseeing it is varied in its protection and development The current legal frame under law 10/03, concerning the exploitation and conditions of agricultural lands belonging to the state, introduced a new framework based on the concession which led to the implementation of the agricultural partnership contracts. independently of state support, aiming to integrate these investments in to productive cycles and develop the agricultural sector. However, has this approach succeeded, and have the legal provisions related to it achieved their intended goals ? Or have the partnership contracts become an obstacle to the investments in the agricultural sector, subsequently impacting the sector’s productivity ? These questions are explored in the following article.
