Résumé: مسؤولية الأمم المتحدة عن انتشار وباء الكوليرا في هايتي إعداد د. لونا سعيد فرحات تبحث هذه الورقة في مسؤولية المنظمات الدولية عن الاضرار التي تسببها للغير وتحديدا انتشار الاوبئة كما حدث في هاييتي على إثر ارسال الامم المتحدة قوات البعثة الخاصة لمساعدة هاييتي من آثار الزلزال المدمر . فقد تم رفع دعوى جماعية أمام محكمة نيويورك في الولايات المتحدة ضد الامم المتحدة ، بالنيابة عن أسر أكثر من ثمانية آلاف قتيل ومئات الالاف من المصابين بوباء الكوليرا منذ تفشي المرض أواخر العام 2010 . محامو الضحايا طالبوا الامم المتحدة بالتعويض مدعين ان قوات الامم المتحدة هي التي أدخلت المرض عن غير قصد إلى هاييتي في ديسمبر 2010 . طالب وكلاء الضحايا إضافة إلى التعويض المالي بناء نظام للصرف الصحي في هاييتي للسيطرة على الوباء ومنع تكرار حصول ذلك في المستقبل وتقديم اعتذار رسمي للضحايا عن الافعال غير المشروعة والصادرة عن قوات السلام الاممية . إلا ان الأمم المتحدة تمسكت بالحصانة القضائية التي تتمتع بها وفقا للقانون الدولي وهو ما اكده القضاء الأمريكي لتبرير رفضه الاستماع إلى الدعوى. وخلصت الدراسة إلى ان الامم المتحدة لها ان تتمسك بالحصانة القضائية ولكن على ان تحدد الالية القانونية البديلة لضمان حقوق المتضررين فالحصانة القضائية للمنظمة الدولية لا يعني أبدا عدم المسؤولية من ناحية ـ، ولا يعني حرمان المتضرر من حق التعويض . الكلمات المفتاحية: المسؤولية الدولية، المنظمات الدولية، التعويض عن الضرر، الحصانة القضائية الدولية، وباء الكوليرا This paper examines the responsibility of international organizations for the damage they cause to others, specifically the spread of epidemics, as happened in Haiti, following the dispatch of the United Nations special mission forces to help Haiti from the effects of the devastating earthquake. A case law has been filed in a New York court in the United States against the United Nations, on behalf of the families of more than 8,000 people killed and hundreds of thousands infected with cholera since the outbreak in late 2010. Claiming that UN peace forces from Nepal accidentally introduced the disease to Haiti in December 2010. In addition to financial compensation, the victims' agents called for building a sanitation system in Haiti to control the epidemic, prevent a recurrence in the future and make a formal apology to the victims for the illegal acts of the UN peace forces. However, the United Nations has maintained its judicial immunity in accordance with international law, which the U.S. judiciary has confirmed to justify its refusal to hear the case. The study concluded that the United Nations has the right to uphold judicial immunity but to define the alternative legal mechanism to guarantee the rights of compensation of those affected by the harm caused by the UN.
