La Liberte D’investir En Algerie, Les Seuils D’eligibilite Aux Avantages Et La Simplification Des Procedures

Résumé: La volonté de promouvoir l’investissement privé national et étranger est clairement inscrite dans le texte constitutionnel qui énonce « L’Etat œuvre à améliorer le climat des affaires. Il encourage, sans discrimination l’épanouissement des entreprises au service du développement économique et social ». Cette volonté s’est exprimée par l’adoption du nouveau code des investissements qui va régir, pour l’avenir l’investissement privé national et étranger. Cependant par rapport aux législations antérieures sur l’investissement la loi du 3 août 2016 est restrictive quant au type d’investissement entrant dans son champ d’application : seuls ceux faisant partie des branches « utiles » et dont a besoin l’économie nationale, entrent dans le champ d’application de la loi du 3 août 2016 et bénéficient de garanties de l’Etat. La loi du 3 août consacre 15 articles aux avantages consistant en une modulation de ces avantages en fonction de la politique économique du pays. Ces avantages sont accordés « de droit » aux investissements par rapport à l’ordonnance du 26 août 2001 qui subordonnait l’octroi de ces avantages à une décision de l’Agence Nationale de Développement de l’Investissement (ANDI). The desire to promote domestic and foreign private investment is clearly enshrined in the constitutional text which states "The State works to improve the business climate. It encourages, without discrimination, the flourishing of enterprises in the service of economic and social development ". This desire was expressed by the adoption of the new investment code which will govern, for the future, the national and foreign private investment. However, compared to the previous legislation on investment, the law of 3 August 2016 is restrictive as to the type of investment falling within its scope : only those belonging to "useful" branches and which the national economy needs, fall within the scope of the law of 3 August 2016 and benefit from State guarantees. The law of August 3 devotes 15 articles to the benefits consisting of a modulation of these advantages according to the economic policy of the country. These benefits are granted " jure" to the investments compared to the ordinance of August 26th, 2001 which subordinated the granting of these advantages to a decision of the National Agency of the Development of the Investment (ANDI).
