جنحة منح إمتيازات غير مبررة في مجال الصفقات العمومية

Résumé: ملخص : إن إعمـال مبـادئ حريـة الـوصول للطلبـات العمـومية و المسـاواة فـي معاملـة المتـرشحين وشفافية الإجـراءات فـي مجـال الصفقـات العموميـة ، يعـد مـن الشـروط الأساسيـة التـي يتـوقف عليها نجاعة الطلبـات العموميـة ، فالمبـادئ الثـلاثة بما تثيره من تعدد في العروض وتنوع في الخيارات، تسمح للإدارات العمـومية بإستخـدام المـوارد العمـومية إستخـداما عقلانيا و رشيدا ، و يضفي على طلباتها قدرا من الشفافية و النزاهـة . وهي كـذلك بما تتيحه للمتعاملون المتعاقدون من فرص للوصول لتلك الطلبات، تعد أفضل وسيلة لتحقيق حقوقهم المشروعة في ممارسة حريتي التجارة و الصناعة في إطار من المنافسة المشروعة . أمام هذه المصالح الجديرة بالحماية، تدخل المشرع الجنائي إلى تجريم الإعتداء على هذه المبادئ العامة التي تحكم الصفقات العمومية من خلال جنحة منح إمتيازات غير مبررة في مجال الصفقات العمومية . Abstract: Applying principles of free access to public orders, equal treatment of applicants and transparency of public procurement is an essential condition on which depends the efficiency of public orders. These three principles, besides the advantages they offer such as diversifying offers and options, they allow public administrations to use public resources wisely and soundly along with transparent and unbiased decisions. No doubt this course of action enables contractors to have opportunities to access to orders and constitutes the best way to secure the legal rights in trading and manufacturing freely within the framework of legal competition. In order to preserve these interests worthy of protection, the legislator of the penal law intervened to criminalize the offense against general principles governing public procurement by introducing the offence of granting unjustified advantages.
