مسالك درء التعارض بين النصوص القطعيّة وأخبار الآحاد
Résumé: قد يجد الدارس لأخبار الآحاد نوعًا من عدم الاِنسجام الداخليّ مع روح القرآن الكريم ومنطقه العامّ، فالأوْلى به في المقام الأوّل أن يسعى للجمع والتوفيق بينهما بصرف الحديث عن ظاهره وتأويله بما يتوافق مع دلالات كتاب الله ؛ إعمالا لقاعدة: «الجمع أولى من الترجيح» أمّا إذا لم يجد سبيلا للجمع، والتبس عليه الأمر، وكان التأويلا بعيدا ومتعسّفا فيسعُه التوقّف. وهذا مسلكٌ أسلمُ وأولى من القبول أو الردّ. وأمّا إذا كانت المعارضة حقيقيّة؛ فلا بدّ من ردّ خبر الآحاد وترجيح دلالة القرآن عليه؛ لأنّ القطعيّ مقدّم على الظنّيّ عند التعارض. The jurist may find kind of inconsistent between Hadith ones and definitive evidence, «Quranic verse» in the beginning He must try to combine and reconcile between them by distracting its apparent meaning in line with the indications of the Quranic verse. When this is not possible, or confused about it, or the meaning was far away; in all this cases the jurist needs to stop judging until the meaning becomes clear to him. But if it is not possible to combine between them anyway; He should refuse the Hadith and accept the Quranic verse; because the conclusive evidence is presented on the presumptive evidence if it is not possible to combine.
