التراث الثقافي الديني سبيل لكفالة حرية المعتقد وممارسة الشعائر الدينية عند الطفل.

Résumé: ترمي هذه الدراسة الى وضع مقاربة قانونية للعلاقة الطردية التي تربط بين التراث الثقافي الديني وحرية المعتقد وممارسة الشعائر الدينية للطفل عامة والطفل المسلم بشكل خاص، ومدى مساهمة هذه الكنوز الثقافية الدينية في ضمان تنشاة دينية للطفل في كل مراحله العمرية الى حين بلوغه سن الرشد، وبلورة شخصيته الدينية من الجانبين الفكر والروحي وتكوين هويته الدينية. لذا وجب حماية هذه الموروثات الثقافية والحفاظ عليها وتثمينها، باعتبارها من اهم الدعائم التي تكفل حرية المعتقد وممارسة الشعائر الدينية لدى الطفل. This study aims to develop a legal approach to the expellive relationship between religious cultural heritage, freedom of belief and the practice of religious rites of the child in general and the Muslim child in particular, and the extent to which these religious cultural treasures contribute to ensuring the religious establishment of the child at all stages of his or her age until he reaches the age of majority, and to crystallize his religious personality from both sides of thought and spirituality and the formation of his religious identity. These cultural heritages must therefore be protected, preserved and valued, as one of the most important pillars of freedom of belief and religious practice among children.
