حرية الترشح بين التكريس الدستوري ومقتضيات النص التشريعي انتخابات أعضاء المجلس الشعبي الوطني 12 جوان 2021 نموذجا

Résumé: الملخص: لقد أقر الأمر رقم 21-01،المتضمن القانون العضوي المتعلق بنظام الانتخابات ، المعدل والمتمم؛ مجموعة من الضمانات والآليات للحق في الترشح لانتخابات أعضاء المجلس الشعبي الوطني، وهذا بغية إفراز سلطة تشريعية تُعبرعن السيادة الشعبية وتُعزز الديمقراطية وتُترجم مطالب حراك 22 فبراير 2019، وبالرغم من هذه الضمانات إلا أنَ المشرع الجزائري في المادة الانتخابية نصَ على مادة جديدة ذات مفهوم فضفاض ، وهي المادة 200 الفقرة 7، من القانون الانتخابي الجديد، أقصت العديد من المترشحين ، مما أفرزت إشكالات عديدة تتعلق بالصياغة التشريعية ؛المساس بالحقوق والحريات ، وبلورة نمط جديد في صناعة القانون، وهو تأثير الحراك على صياغة القانون الانتخابي. Abstract: Order 21-01, containing the Organic Law for the Electoral System, amended and supplemented, set a group of guarantees and mechanisms for the right to run for elections for members of the People's National Assembly. This is in order to form a legislative authority that expresses popular sovereignty, strengthens democracy, and meets the demands of the Hirak of February 22, 2019. In spite of these guarantees, the Algerian legislator stipulated, regarding the electoral article, a new article with a broad concept. It is Article 200, paragraph 7, of the new electoral law, which excluded many candidates. This resulted in many problems related to legislative drafting, rights and freedoms, and the importance of the Constitutional Council (the Constitutional Court) in establishing and protecting rights and freedoms, in addition to the impact of Hirak on drafting the electoral law.
