النـظـام القـانـوني للـصيـرفـة الإسلاميـة والتـمويـل الـعقـاري فــي الجـزائـر
Résumé: ملخص الدراسة: تهدف هذه الدراسة إلى تسليط الضو على واقع الصيرفة الإسلامية في الجزائر من خلال الإطلالة على وضع النوافذ الإسلامية في الجزائر، وكذلك إلقاء الضو على الأساليب والصيغ الإسلامية التمويلية في المجال العقاري وتطبيقها في البنوك السلامية في الجزائر. ففي هذه الدراسة تم التطرق إلى النظام القانوني للصيرفة الإسلامية ودورها في الجانب العقاري من خلال الأحكام والنصوص القانونية الصادرة في النظام 20- 02 والتعليمة 23- 03، والقانون 23- 09 للوقوف على مدى رغبة المشرع في تطوير النشاط المصرفي الإسلامي في الجزائر. Study sammary: The aim of this study is to highlight the reality of Islamic Currency in Algeria throughout the Islamic methods used in the process, Not to mention The Islamic funding formats when it comes to the real-estate, and how this is applied in Algerian Islamic Banks. In this study, we touched on the legal system of the Islamic Bank and its role in the field of real-estate according to legal provisions and acts, in the system 20-02 and the instruction of 20-30 and the law of 23-09 in order to determine how the legislator is willing to develop activities related to Islamic Banks in Algeria.
