التراث الثقافي و السياحة -العلاقة و الحماية-

Résumé: يعبر التراث الثقافي عن هوية الأمة الجزائرية و شعبها ، و هو عبارة عن رسالة ثقافية تاريخية مفتوحة للجمهور العام الوطني و الأجنبي ، تعمل على التعريف بالمجتمعات المحلية و عاداتهم و تقاليدهم و ثقافاتهم ، كما تبين مقدرات الأمة السياحية من تراث طبيعي و تراث ثقافي ، و هو ما يطلق عليه بالسياحة التراثية أو بما يسمى في القانون الجزائري بالسياحة الثقافية . هذا المصطلح المركب يضم مفهومين متلازمين متكاملين متبادلين الأبعاد حيث يتأثران ببعضهما البعض إيجابا و سلبا من حيث طريقة استغلالهما و تسييرهما ، فإذا تم استغلال التراث الثقافي في النشاط السياحي دون ضوابط تأثر سلبا بيئيا و اقتصاديا و اجتماعيا و ثقافيا ، و إذا تم استغلاله بعقلانية و استدامة فانه يضمن الى حد ما حمايته وفق قواعد و ضوابط قانونية تعمل على تدعيمه و تثمينه و في الوقت نفسه تطوير السياحة التراثية و تنميتها في إطار التنمية المستدامة و هذا ما تبناه المشرع الجزائري في إطار قانون التراث الثقافي و قانون السياحة المستدامة . Abstract: Cultural heritage describes the identity of the Algerian nation and its people. It aims to introduce local communities; their customs; traditions; and cultures, as well as, shows the nation’s tourism capabilities of natural and cultural heritage. This compound term includes two interrelated, complementary, and mutually dimensional concepts that affect each other positively and negatively. If the cultural heritage is exploited in the tourism activity without controls, it will be negatively affected environmentally, economically, socially, and culturally. However, if it is exploited rationally and sustainably, it will guarantee to some extent its protection according to legal rules and regulations that work to support and value it, at the same time, it will develop heritage tourism within the framework of sustainable development, and this is what the Algerian legislator has adopted within the framework of the Cultural Heritage Law and the Sustainable Tourism Law.
