المجلس الوطني لحقوق الإنسان كهيئة استشارية في ضوء التعديل الدستوري 2020

Résumé: ملخص: يُعدّ المجلس الوطني لحقوق الإنسان بمثابة هيئة دستورية استشارية لدى رئيس الجمهورية و ذلك بمقتضى المادة 211 من التعديل الدستوري الأخير لسنة 2020، والتي تُظهر الطبيعة الإدارية لهذا المجلس كهيئة مستقلة تتمتع بالاستقلالية المالية. هذا ،وكان قد صدر القانون 16-13 يحدد كيفية الذي تعيين أعضاء المجلس و القواعد المتعلقة بتنظيمه وسيره، ثم تدعيما له صدر المرسوم الرئاسي رقم 17-76 الذي يحدد تشكيلة المجلس الوطني لحقوق الإنسان و نظامه الداخلي. Abstract: The National Council for Human Rights is considered as a constitutional consultative body to the President of the Republic according to article 211 of the latest constitutional amendment of 2020, which shows the administrative character of this Council as an independent body with financial autonomy. In addition, Law 16-13 that specifies the method of appointment of the members of the Council and the rules relating to its organization and operation was promulgated, then, in support of this Law, Presidential Decree No. 17-76 was promulgated, which defines the composition of the National Council for Human Rights and its rules of procedures.
