المعالجة التشريعية لجرائم اختطاف الأطفال

Résumé: جريمة اختطاف الأطفال هي نقل الطفل الذي لم يبلغ ثامنة عشرة سنة كاملة أو حجزه أو القبض عليه أو أخذه أو اعتقاله أو احتجازه أو أسره، بصفة مؤقتة أو دائمة، باستعمال القوة أو التهديد أو الخداع، وعادة ما يهدف الاختطاف إلى ارتكاب جريمة یسعى إليها الجاني كاستغلال الطفل المختطف في الأغراض الجنسية أو الحصول على مبلغ مالي أو الاتجار بأعضائه، أو تعذيبه لحد الموت، ولهذا تعد من أخطر الجرائم لأنها تمس الفئة الضعيفة في المجتمع، هذا ما دفع بالمشرع الجزائري إلى التصدي لهذه الجريمة في قانون العقوبات من خلال تشديد العقوبة والتي تصل إلى حد الإعدام. Abstract: Kidnapping is the transfer, detention, arrest, taking, arrest, detention or capture of a child under 18 years of age, temporarily or permanently, by force, threat or deception, usually with the aim of committing an offense sought by the offender as the exploitation of the abducted child. This is one of the most serious crimes because it affects the vulnerable group in society, which prompted the Algerian legislator to adress This crime in the Penal Code by tightening the penalty up to the death penalty.
