مسؤولية الموظف العام عن إساءة استعمال السلطة_دراسة تحليلية على ضوء التشريع الجزائري

Résumé: إن جرائم إساءة استعمال السلطة من الجرائم الخطيرة التي تتعارض مع نزاهة الوظيفة العامة وتؤدي إلى المساس بحقوق وحريات الأفراد، وقد يصل الأمر إلى درجة اضطراب النظام العام، وإلحاق الضرر بالمصلحة العامة، وعليه تهدف هذه الدراسة إلى جملة من الأهداف أبرزها الوقوف على صور جريمة إساءة استعمال السلطة و تحديد المسؤولية المترتبة عن إساءة استعمال السلطة. ومن خلال هذه الورقة البحثية وفي سبيل البحث في الإشكالية المطروحة تم التوصل الى جملة من النتائج لعل أبرزها: إن مسؤولية الموظف العام مرتبطة مع سلطته الوظيفية فبقدر السلطة الممنوحة له تكون مسؤوليته، كما أن المشرع الجزائري في تنظيمه للمسؤولية الجزائية للموظف جعل كل جرائم إساءة استعمال السلطة ذات عقوبات جنحية. Abstract: The crimes of abuse of power are among the serious crimes that conflict with the integrity of the public office and lead to compromising the rights and freedoms of individuals, and the matter may reach the point of disturbing public order, and harming the public interest. Authority and determine the responsibility resulting from the abuse of power. Through this research paper, and in order to research the problem at hand, a number of results were reached, perhaps the most prominent of which are: The responsibility of the public employee is linked with his functional authority, as much as the authority granted to him is his responsibility, and the Algerian legislator, in his organization of the criminal responsibility of the employee, made all crimes of abuse of authority with misdemeanor penalties.
