مسئولية البنك في حال عدم الكشف عن غسل الأموال" دراسة مقارنة"

Résumé: توجب قاعدة سرية الحسابات البنكية الحظر على موظفي البنوك بموجب نصوص القانون، عدم إفشاء أية معلومات تتعلق بالمعلومات تتعلق بالعملاء إلا هناك استثناء على هذه القاعدة لتفويت الفرصة على غاسلي الأموال وكشف العمليات المشبوهة. فإفشاء السر المصرفي هنا يعفو البنك من المسؤولية التقصيرية أو العقدية وكذلك المسؤولية الجنائية، وعلى العكس من ذلك يتعرض البنك وغيره من المؤسسات المالية لعقوبة الغرامة إذا ثبت تقصيرها في مخالفة الحظر على فتح حسابات مشبوهة الهوية أو حسابات بأسماء وهمية أو رمزية أو التقصير في التحقق من هوية العملاء وفقاً للوثائق الرسمية الصادرة من الدولة لاسيما تعليمات البنوك المركزية بشأن عمليات غسيل الأموال وتمويل الإرهاب، وتتباين الجهات التي تتلقى البلاغات عن العمليات المشبوهة من تشريع لآخر فقد تكون جهات قضائية وقد تكون وحدات خاصة أنشأت لتطبيق قانون مكافحة غسيل الأموال.
