Résumé: Studying the legal system for the foreign trader in Algerian legislation requires two important aspects. The first aspect turns around knowing the concept of the foreign trader in terms of the status of the foreigner and the legal status of the trader. The Algerian legislator aknowledgedto the foreigner the legal personality .He determined this legal status on various bases. On the commercial side, he often relied on the principle of egalitarianism between the foreigner and the national and discrimination when obliging the foreign trader to obtain the residence card and the professional card of the foreign trader. The second aspect concerns the obligations of the foreign trader, which do not differ greatly from the obligations of the national one in terms of maintaining commercial books, registration in thenationalcenterof trade register, and penalties for defaulting on them.
