دور أموال الفائض التأميني في نمو وتطور صناعة التأمين التكافلي الاسلامي

Résumé: ملخص: تناولنا في هذه الدراسة؛ التأمين التكافلي الذي يتم من خلاله التضامن والتكافل بين أفراد المجتمع في دفع الأضرار وترميم جميع المخاطر المؤمنة، من مجموع الاشتراكات التي يدفعونها على سبيل التبرع، وهي خاصية يتميز بها التأمين التكافلي الإسلامي عن التأمين التجاري. وتوصلنا إلى أهمية نظام توزيع الفائض التأميني في تحقيق الموازنة بين مبدأ التكافل، وتحقيق العدالة والمساواة بين أعضاء هيئة المشتركين، مما يساهم في ترسيخ فكرة التأمين التكافلي الإسلامي، ويؤكد مصداقية شركات التأمين التكافلي والتزامها بأحكام الشريعة الإسلامية في تقديمها لخدمات التأمين بمقتضى عقد التأمين التكافلي كبديل شرعي عن عقد التأمين التجاري.
