الإرهاب وآليات مكافحته على ضوء قانون الإجراءات الجزائية الجزائري

Résumé: تهدف هذه المقالة إلى دراسة أخطر الجرائم العابرة للحدود وهي الجريمة الإرهابية، فقد تعاظمت مؤخرا خطورة هذه الجريمة لتصبح ذات طابعا دوليا، كما انتشرت بشكل رهيب داخل مجتمعاتنا العربية، ما استدعى من الدول اتخاذ جملة من التدابير قصد حماية مواطنيها وحفظ النظام العام. وعليه، تبنى المشرع الجزائري سياسة جنائية قائمة على مجموعة من الآليات الموضوعية والإجرائية لمكافحة هذه الجريمة. سنخصص هذه الورقة البحثية لدراسة الآليات الإجرائية التي أدخلها المشرع الجزائري في قانون الإجراءات الجزائية، من أجل ردع مرتكبي الجريمة الإرهابية وتحقيق فعالية في إجراءات المتابعة الجزائية، من خلال توسيع صلاحيات الشرطة القضائية، وانعقاد الاختصاص للفصل في القضايا الإرهابية لمحكم الجنايات الابتدائية بتشكيلة خاصة وللأقطاب الجزائية. The aim of this article is to study the most serious transnational crime: Terrorism. The seriousness of this crime has recently grown to become international in nature and has spread terribly within Arab societies. Therefore, it was required from countries to take a number of measures to protect their citizens and maintain public order. In this way, the Algerian legislator has adopted a criminal policy based on a set of objective and procedural mechanisms to combat this crime. We will devote this paper to the study of procedural mechanisms introduced by the Algerian legislator in Criminal Procedure Code, in order to deter predators of terrorist crimes and to achieve effective follow-up in criminal proceedings. These can be attained through expansion of judicial police power and the convening of jurisdiction to adjudicate terrorist cases for the first instance criminal judge with a special composition and for the special criminal courts.
