Résumé: "هذا البحث الموسوم ب ""أركان الجريمة البيئية بين الفقه الاسلامي والقانون الجزائري (دراسة مقارنة)""الجريمة المائية أُنموذجاً، كان الإشكال الرئيس الذي حاولت الإجابة عنه هو التعريف بأركان الجريمة البيئية وإظهار العلاقة بين أركانها في الفقه الاسلامي والقانون الجزائري. وأجابت الدراسة عن ذلك من خلال مبحثين: جُعِل أوَّلهما في بيان المفهوم للجريمة البيئية والأساس الشرعي والقانوني لها، وخُصِّص الثاني للركنين المادي والمعنوي للجريمة البيئية؛ مستشهدا بالجريمة المائية كمثال تطبيقي، ومن أهم النتائج المُتوصَّل اليها من هذه الدراسة أنه يجب توضيح مفهوم للبيئة وضعف صياغة النصوص القانونية التي وقع فيها المشرع الجزائري ""This research entitled: "" The Elements of Environmental Crime between the Islamic Fiqh and the Algerian Law"" tends to answer the main problematic that is defining the elements of the environmental crime and revealing the relationship between those elements in the Islamic fiqh and the Algerian law. The study in hand answered the question through two sections: the first is intended to define the concept of the environmental crime as well as its grounding in the Islamic legislation and law. The second part was devoted to the material and spiritual elements of that crime. Among the important results this study came to was the clarification of the concept of the environment and the Algerian legislator' s weakness in legal texts drafting. "
