الوساطة الجنائية كإجراء بديل لحل المنازعات الجنائية

Résumé: الملخص : أصبحت السياسات الجنائية المعاصرة ، تتجه إلى اعتماد الطرق البديلة كوسيلة لحل المنازعات الجنائية ، فالتزايد في معدل الجرائم أدى إلى إكثار الدولة من استعمال حقها في استخدام الدعوى العمومية ، الأمر الذي أدى إلى إنهاك كاهل القضاء بكثرة القضايا واستنزاف مواردها البشرية والمادية ، فكان المنفذ في بدائل الدعوى العمومية والتي من أهمها الوساطة الجنائية ، التي أصبحت تلعب دورا هاما في فض المنازعات خصوصا تلك الناجمة عن الجرائم البسيطة ، فضلا عن دورها في تكريس معاني العدالة التصالحية وخصخصة الدعوى الجنائية ، لذلك نجد المشرع الجزائري قد تبنى الوساطة كبديل للدعوى العمومية ضمن أحكام الأمر15– 02 الصادر في 23/07/ 2015 المعدل والمتمم للأمر 66– 155 المتضمن قانون الإجراءات الجزائية وكذا القانون 15–12 الصادر في 15/07/ 2015 المتعلق بحماية الطفل. الكلمات المفتاحية : الوساطة الجنائية ، الإجراءات البديلة ، الطرق البديلة ، حل المنازعات الجنائية ABSTRACT : Contemporary criminal policies have tended to adopt alternative methods as a means of resolving criminal disputes. The increase in the rate of crimes has led to the multiplication of the State's use of its right to use public proceedings. This has led to the exhaustion of the judiciary and the depletion of its human and material resources. The most important of which is the criminal mediation, which has become an important role in the resolution of disputes, especially those arising from minor crimes, as well as its role in consecrating the meaning of restorative justice and the privatization of criminal proceedings, so we find the Algerian legislator adopted mediation as an alternative Of the Public Prosecution within the provisions of Order 15-02 issued on 23/07/2015 amended and supplemented by Order 66- 155 including the Code of Criminal Procedure as well as Law 15-12 of 15/07/2015 on the protection of the child.
