الذكاء الاصطناعي في المدينة الذكية: تحليل التفاعل بين الابتكار التكنولوجي والتأطير القانوني والأخلاقي.

Résumé: يهدف هذا المقال العلمي إلى الوقوف على الدور الذي يلعبه الذكاء الاصطناعي في المدنية الذكية وإبراز أهمية تأطيره القانوني والأخلاقي، ويناقش المقال إشكالية التوفيق بين التطور التكنولوجي والحفاظ على الحقوق والحريات الأساسية في المدينة الذكية؛ من خلال التطرق لأهم التشريعات المؤطرة للبيئة الرقمية مع التركيز على مساعي الجزائر في ذلك، كما يتناول التحديات التي تثيرها مسألة التأطير القانوني للذكاء الاصطناعي، ويسلط الضوء على وجهات النظر المختلفة المتعلقة بالموضوع؛ حيث توجهت بعض الآراء نحور تغيير جذري للفكر القانوني القائم حاليا على اعتبار أن الاعتراف للذكاء الاصطناعي بالشخصية القانونية يقدم حلولا مناسبة، وبعضها على خلاف ذلك يرى أنه من الضروري الحفاظ على المنظومة القانونية الحالية مع العمل على تطويعها لتستوعب هذه التحديات، وتوصلت الدراسة إلى أن إبقاء أنظمة الذكاء الاصطناعي ضمن فئة الأشياء الخاضعة لسيطرة البشر وتحت مسؤوليتهم مع حظر الخطرة منها والسماح فقط بإدخال الآمنة حيز التشغيل أمر ضروري لتحقيق التطور الآمن والمسؤول؛ كما أن التوفيق بين التطور التكنولوجي وحماية الحقوق والحريات ورغم كل المساعي لا يزال يشكل تحد معقد لكن ممكن؛ ويتطلب مواصلة الجهود للحفاظ على حقوق الأفراد وحرياتهم دون إعاقة التقدم والابتكار. Abstract: This scientific article aims to examine the role of artificial intelligence in the smart city and to emphasize the importance of its legal and ethical framework. It discusses the issue of reconciling technological progress with respect for fundamental rights and freedoms in this context. To do so, it addresses the main legislations governing the digital environment, with a focus on Algeria's efforts, and deals with the challenges posed by AI’s legal framework. Different views are then presented: some advocate a radical change in the current legal system through the recognition of legal personality for artificial intelligence; others advocate maintaining the existing legal framework, which should adapt to meet these challenges. The study concludes that it is necessary to keep artificial intelligence systems under human control and responsibility, to ban dangerous technologies, and to only authorize safe developments, to enable progress that is both responsible and beneficial to society. Although complex, reconciling technological innovation with the protection of fundamental rights remains an achievable goal that requires continued efforts in this direction. The article thus seeks to provide scientific and multidisciplinary insight on this complex issue, at the intersection of ethics, law, and technology.
