تقدير ميراث الحمل بين الفقه والطب

Résumé: الحمل قد يكون من جملة الورثة، جاء هذا البحث لتحديد ميراث الحمل في الفقه الإسلامي، في أقل مدة الحمل وأكثرها، ومن ثم رأي الطب الحديث ومدى الاعتماد عليه في ميراث الحمل، وموقف القانون الجزائري. وقد توصلنا من خلال الدراسة أن حق الحمل في الميراث يقدر وفق اراء الفقه الإسلامي والرجوع إلى التطور العلمي والطب الحديث لتحديد اقل مدة الحمل وأكثرها، وان الفقه الاسلامي والطب والقانون قدروا اقل مدة الحمل بستة أشهر. لم يرد نص في تحديد أقصى مدة الحمل في كتاب الله تعالى، أو سنّة رسول الله صلى عليه وسلم، وحددها القانون الجزائري أقصاها عشرة أشهر. Pregnancy may be among the heirs. This research came to determine the inheritance of pregnancy in Islamic jurisprudence. And the position of the jurists regarding the shortest and most prolonged period of pregnancy; and then the opinion of modern medicine and the extent of reliance on it in the inheritance of pregnancy; and the position of Algerian law ; We have concluded that the right of pregnancy to inheritance is estimated according to the views of Islamic jurisprudence and reference to scientific development and modern medicine to determine the minimum and maximum duration of pregnancy, Islamic jurisprudence, medicine, and law estimated the minimum period of pregnancy to be six months. There is no text specifying the maximum duration of pregnancy in the Quran; or the Sunnah of the Messenger of God, peace and blessings be upon him, and Algerian law specified it as a maximum of ten months.
