تفويض مرفق التموين بمياه الشرب في إطار القانون رقم 05 - 12 المتعلق بالمياه

Résumé: يكتسي المرفق العمومي للتموين بمياه الشرب في الجزائر أهمية بالغة لأنه يتعلق بمادة حيوية للفرد ألا و هي الماء، و التي يتعين توفيرها للجميع بصفة مستمرة و متكيفة مع حاجياتهم من حيث الوفرة و النوعية، و لبلوغ هذه الغاية عكفت السلطات العمومية على تبني عدة أساليب لتسيير خدمات المياه كان آخرها أسلوب تفويض الخدمة العمومية للمياه الذي أقره القانون رقم 05 – 12 المؤرخ في 4 أوت 2005م المتعلق بالمياه، إلا أن التفويض بمفهوم هذا القانون يختلف عن التفويض بالمفهوم العام أي في النظرية العامة و يتميز عنه في أمور معينة سيتم كشفها من خلال هذه الورقة البحثية . ثم أن تبني التفويض بموجب قانون المياه المذكور أعلاه قد أثار عدة مخاوف من خوصصة مرفق المياه لا سيما مع بداية تجريبه في بعض مدن الوطن، إلا أن هذه المخاوف ستتبدد بمجرد توضيح الرؤى فيما يخص مسألة تفويض مرفق المياه و الخوصصة . The public utility for supplying drinking water in Algeria is of great importance, because it is related to a vital substance for the individual, namely water, which must be provided to all, on a continuous basis and adapted with their needs in terms of abundance and quality, and to achieve these The purpose, the public authorities have embarked on adopting several methods for managing water services, the last of which is the method of delegation the public service for water, which was approved by Law No. 05-12 of August 4, 2005 AD related to water, However the mandate for the concept of this law differs On delegation in the general concept, that is, in general theory, and is distinguished from it in certain matters, which will be revealed through this, the research paper. Moreover, the adoption of the delegation according to the water law, mentioned above, has raised several concerns about the privatization of the water utility, especially with the beginning of its testing in some cities of the homeland However, these concerns will dissipate once the visions are clarified regarding the issue of delegating the water utility and privatization.
