التحديات القانونية والأخلاقية المتعلقة بالتجارب الجينية. -دراسة تحليلية-

Résumé: الملخص : يتناول هذا البحث التحديات القانونية والأخلاقية الناشئة عن التجارب الجينية والتدخل في الجينوم البشري، مسلطًا الضوء على التوتر القائم بين حرية البحث العلمي وضرورة حماية الكرامة الإنسانية والسلامة الجسدية. ويركّز على تحليل الآثار المترتبة على التقدّم في تقنيات الفحص والتعديل الوراثي، وما تثيره من إشكالات تتطلب أطرًا تنظيمية فعالة ومتوازنة. يعتمد البحث المنهجين الوصفي والتحليلي لتفكيك أبعاد هذه الإشكالية، وينتهي بجملة من النتائج والتوصيات الهادفة إلى دعم الموازنة بين التقدّم العلمي والضوابط القانونية والأخلاقية الحاكمة له. This study examines the legal and ethical challenges arising from genetic experimentation and human genome interventions, highlighting the tension between scientific freedom and the imperative to protect human dignity and bodily integrity. It focuses on the implications of advances in genetic testing and modification technologies, which necessitate the establishment of effective and balanced regulatory frameworks. Employing both descriptive and analytical methods, the research unpacks the core dimensions of this issue andconcludes with findings and recommendations aimed at ensuring a responsible integration of scientific progress within sound legal and ethical boundaries
