الضمانات الخاصة بحماية المستهلك في مجال العقود الموجهة الكترونيا تطبيقا لأحكام القانون رقم 18/05.

Résumé: ملخص: تم التطرق من خلال هذا البحث الى أهم الضمانات التي استهدفها القانون الجزائري والخاصة بالمستهلك في مجال التجارة الالكترونية، باعتبار أن هذا الأخير هو محور العملية الاستهلاكية الالكترونية، وذلك من اجل تشجيع ثقة المستهلك في التعامل الالكتروني. حيث تم دراسة آليات حماية المستهلك الالكتروني ما قبل تنفيذ العقد الالكتروني كمرحلة حساسة تستهدف التعاقد، بالإضافة إلى توفير الحماية في مرحلة تنفيذ العقد كمرحلة لاحقة في التعاقد الالكتروني،نظرا أن هذا النوع من التعاقد هو تعاقد معنوي غير مادي يختلف عن التعاقد التقليدي،لذا نجد ان المشرع قد أولى حماية خاصة بالمستهلك بالطرق القانونية اللازمة للتعاقد من خلال إصدار قانون رقم 05/18 وفي الأخير تم طرح بعض الاقتراحات والنتائج التي يمكن للمشرع النظر إليها في مجال التجارة الالكترونية من اجل تشجيع عملية التعاقد الالكتروني. الكلمات المفتاحية:التجارة الالكترونية، التعاقد الالكتروني، العملية الاستهلاكية، المستهلك، التاجر. Abstract: The important comprised safeguards within the Algerian law have been addressed. These safeguards are concerned with the consumer in the electronic trade domain,sincethe latter is considered as the major focus of the consumptive electronic operation, in the view of fostering the consumer trusting the electronic interaction. The mechanisms of protecting the electronic consumer have been studied in the step prior to the electronic contract implementation, as a sensitive matter targeting the contract, besides providing security in the stage of contract implementation as a subsequent step in the electronic contract, since this kind of contractis moral; it differs than the traditional one. Therefore, the legislator has paid special attention to the consumer through the necessary legal procedures for contract. Finally, some suggestions and results are introduced so that the legislator may take them into account, in the domain of the electronic trade, for the sake of fostering the electronic contract.
