خصوصية النظام القانوني للمصنفات في البيئة الرقمية

Résumé: إن التعامل في نطاق المعاملات الإلكترونية يفرض على المتعامل اللجوء إلي استخدام جملة من الأدوات و التقنيات الرقمية سواء كان الهدف من التعامل عرض منتجات أو تلقي طلبات أو دفع الفواتير و المستحقات ؛ و قد تم تصنيف هذه الأدوات و التقنيات من الناحية القانونية على أنها مصنفات فكرية من نوع خاص أطلق عليها تسمية المصنفات الرقمية هذا من جهة ، و من جهة أخرى فإن هذه المصنفات تشكل اغلب ما ينشر في الفضاء الإلكتروني ؛ فالمحتوى الرقمي يشكل اغلب عمليات التبادل التجاري و الاستثماري في العالم و له علاقة مباشرة بالتنمية ،و نظرا لتعرض هذا النوع من المصنفات الى عدة اعتداءات كان لازما إحاطتها بجملة من التدابير الحمائية تقنية كانت أو قانونية كان لها الدور الفاعل في بعث الثقة في التعاملات الإلكترونية و توفير بنية تحتية رقمية لتسهيل التعامل الإلكتروني في جميع جوانب الحياة. Abstract : Managing inside the extent of electronic exchanges requires the client to turn to the utilization of various advanced instruments and innovations, whether the reason for the exchange is to show items, get requests, or address the cost; These apparatuses and methods have been legitimately delegated scholarly works of a unique kind called computerized deals with the one hand, and then again, these works comprise a large portion of what is distributed in the electronic space, as computerized content is the vast majority of the business and venture trades. On the planet and has an immediate relationship with improvement, and given the openness of this kind of works to a few assaults, it was important to encompass them with a bunch of defensive measures, whether specialized or legitimate, that played a functioning part in imparting trust in electronic exchanges and giving an advanced foundation to work with electronic managing in all angles life
