القيمة القانونية للبصمة الوراثية في قضايا إثبات النسب

Résumé: ملخص شهدت البصمة الوراثية تطور سريع على الصعيدين العلمي و العملي ، جعلت منها أهم العلوم المستخدمة في الوقت الحالي في مجالات الطب الشرعي و الأدلة الجنائية ،خاصة فيما يتعلق بقضايا إثبـــات النسب ،لما يحقـــقـــه الدليل المســـتمد من نتــائج تحـــــــليـــــل بصمــــــــــة الحمـــض النووي من قوة جزم عـــالية لا يضاهيها أي نوع آخــــر مـن الاستنتاجات العلمية . وقد كان لاكتشاف البصمة الوراثية الأثر الكبير في مجال نظرية الإثبات و بالتحديد في مجال إثبات النسب بما تتميز به من دقة عالية، وعليه اتجه المشرع الجزائري إلى إقحام هذه الوسيلة في مجال منازعات الأبوة و النسب ،باعتبارها من وسائل الإثبات ذات الحجية القوية،و عليه لضرورة الاستفادة من البصمة الوراثية في المجال القضائي باستخدامها في قضايا إثبات النسب يستوجب على المشرع الجزائري وضع أحكام تفصيلية لها و إصداره قانونا خاصا بها تجنبا لأي غموض أو لبس من شأنه أن يشكل عائقا في القضايا المتعلقة بإثبات النسب فللقاضي السلطة التقديرية في إعمالها كوسيلة إثبات أمام النزاع المطروح أمامه.
