Résumé: تلقي هذه الرسالة الضوء على أثر الظروف الزمانية على جريمة السرقة، والتي تتعلق بأمور تمس كيان الأمة وأمنها وتدخل في مقوماتها ولأنها وقاية للأفراد وصيانة للمجتمع ومقدرات الوطن واستقراره الداخلي وأمنه المجتمعي، وفيها حفظ لكرامة الإنسان، وللظرف الزماني ربط مباشر بالشريعة في رسم وبناء وتشكيل أحكامها الفقهية والعقائدية، فهذه الظروف لها تأثير على العقوبة المقررة، إمما بالإسقاط أو التأخير أو التشديد أو التخفيف، كما أمنها تراعي ظروف الجاني عند تطبيقها، فالشريعة الإسلامية والمشرع الجزائري يربطان تشديد العقوبة وتخفيفها والإعفاء منها بظروف ومن بينها الظرف الزماني الذي ترتكب فيه الجريمة.
