تناسب العقوبة مع العفو في الفقه الإسلامي - إشكالات و توجيهات -

Résumé: تقوم فكرة هذا الموضوع من خلال الرؤية الشاملة للنظام العقابي في الفقه الإسلامي ( الحدود و القصاص و التعازير ) على إشكالات تقررت عند الفقهاء و تقوم على إيجاد توازن بين العقوبة و العفو ، فوضعوا لها مخرجا مبني على إيجاد تناسب يبين متى تكون العقوبة أصلح للجاني و متى يكون العفو عنه أحسن ، و قد أقاموها على أسس هي بمثابة القواعد الكبرى و العامة بها تتحقق العدالة العقابية . The idea of this topic, through a comprehensive consideration of the penal system in Islamic jurisprudence (hudud, qisas, and condolences) is based on questions decided by the jurists whose content is: Finding justice between punishment and amnesty, so they devised a method for it based on finding proportionality that shows when the punishment is better for the offender and when it is Pardon him is better, and they have established it on the major rules by which punitive justice can be achieved.
