القواعد الفقهية المتعلقة بالخطأ وأثرها في الفقه الإسلامي

Résumé: "ملخــــــــــــــــــــص هذه الدراسة الموسومة ب: القواعد الفقهية المتعلقة بعارض الخطأ وأثره في الفقه الإسلامي، وقد كان الإشكال الرئيس الذي تسعى إلى الإجابة عنه هو: ما هي أهم القواعد الفقهية المتعلقة بعارض ""الخطأ""؟. وما هي آثاره في الفقه الإسلامي؟. أجابت الدراسة عن ذلك من خلال مباحث الدراسة الآتية: المبحث الأول: خصصته للتعريف بالقواعد الفقهية، وذكر أنواعها. أما المبحث الثاني فقد جعلتُه في التعريف بالخطأ، وبيان أنواعه، ومن ثَمَّ الفرق بينه وبين المصطلحات ذات الصلة به. وفي المبحث الثالث فقد وضعته لأهم القواعد الفقهية الكلية، والفرعية، المتعلقة به، والآثار المترتبة عليه في حقوق الله تعالى وحقوق العباد. وفي المبحث الرابع والأخير سلطتُ الضوء فيه على نماذج من التطبيقات للقواعد –أي الكلية والفرعية- المتعلقة به. وتوصلت في ختام الدراسة إلى جملة من النتائج، لعلّ أهمها: أن الخطأ هو من أحد أهم العوارض الأهلية التي تعم بها البلوى، وهو مسقط للإثم، وكما توصلت إلى أن القواعد الكلية التي لها علاقة بالخطأ مجموعها قاعدتين، ومن القواعد الفرعية فمجموعها أربعة. " "Summary This study that is called: the fikh rules that has a relationship with Error and its applications, and the main concept is: what are the the most important rules that has a relation with the Error? And its applications? and the answers are through the following researches: First chapter: Was mainly about the definition of the Fikh rules and its types. So the second chapter : it was about the definition of Error and its types and the difference between it and the concepts that are relevant to it . And in the third chapter I have put the important rules of Fikh –the general and specific- that are related to it and the traces that are also relevant to the rights of God and its servant .The fourth chapter which is the last was shed on the practiced examples of the rules –general and specific- related to it. So to sum up I personally have reached that the Error is one of the eligibility beams notion . and it not taken into account. And there are two general rules and four specific. "
