جرائم الصحافة في التشريع الجزائري.

Résumé: ملخص: إن الحرية التي يتمتع بها الصحفي هي حرية مقيدة، وكل تجاوز لهذه القيود يؤدي به الى المساءلة، أي أن هذا الموضوع جاء ليسلط الضوء على المسألة الجزائية للصحفي في إطار ممارسة عمله، الذي هو مضبوط بالدستور وكذا القانون بالإضافة إلى إحترام قيم وأخلاقيات العمل الصحفي والتي يجب عليه التقيد بها لأن لها دور فعال في المجتمع حيث تعد أهم مصدر للتثقيف والتوجيه إضافة إلى أنها تعد مجال للتعبير عن الرأي، مع الإشارة إلى وجود أسباب تنفي المسؤولية عن الصحفي من موانع للمسؤولية من جنون وإكراه وكذا أسباب للإباحة من حق للصحفي في النقد وحقه في نشر الأخبار و التبليغ عن الجرائم غير أنه أغفل إضافة حق الطعن في أعمال الموظف العام أو من في حكمه وكذا الدفع بالحقيقة. إن قانون الاعلام وكذا قانون العقوبات وأخلاقيات المهنة جاء لحماية النظام العام والأدب العامة للمجتمع وكذا لحماية حقوق وحريات الافراد. Abstract: The freedom which enjoyed by the journalist is restricted freedom and any exceeded of these restrictions lead to accountability, this subject came to shed light on the penal issue of the journalist in the framework of the exercise of his work which is governed by the constitution as well as the law, in addition to respect the values and ethics of journalism work, he must abide because of it has an effective role within the society, it is the most important source of education and guidance. In addition, it is an area of opinion expression, With reference to the existence of reasons that deny responsibility for a journalist from obstructions to liability of madness and coercion, as well as reasons to allow the journalist the right to criticize and his right to publish news and report crimes, but he omitted adding the right to challenge the actions of the public employee or his equivalent as well as pushing the truth. The communication law, the penal code, and the code of ethics are designed to protect public order and morals, as well as the rights and freedoms of individuals.
