امتيازات الإدارة في عقود الصفقات العمومية في ظل المرسوم الرئاسي 15-247

Résumé: المـــلخــــص: لقد منح المشرع الجزائري للمصلحة المتعاقدة في مختلف قوانين الصفقات العمومية مجموعة من الامتيازات ,و تبرز هذه الامتيازات في مجموعة من السلطات المتمثلة في تنفيذ الصفقة العمومية في كافة مراحلها من خلال سلطتي الرقابة و التعديل الانفرادي لشروط العقد و كذالك سلطة فرض الجزاءات و سلطة إنهاء العقد. و للمصلحة المتعاقدة الحق في متابعة تنفيذ الصفقة من خلال سلطتي الرقابة و التعديل الانفرادي لشروط الصفقة ,ذلك لضمان سير تنفيذها على النحو المتفق عليه ,كما يمكن لها أن تمارس سلطة توقيع الجزاءات في حالة تقصير أو إخلال المتعامل المتعاقد بالتزاماته , فمنها ما هي مؤقتة و منها ما تؤدي إلى فسخ العقد أي إنهاء العلاقة التعاقدية إذا كان الإخلال جسيماً. Résumé: Le législateur algérien a octroyé au pouvoir adjudicateur, dans le cadre des diverses lois en matière d'opérations publiques, un ensemble de privilèges, qui sont manifestés par un certain nombre d'autorités chargées d'exécuter l'opération à toutes les étapes, par le biais de pouvoirs de contrôle et de modification unilatérale du contrat. Le pouvoir adjudicateur a le droit de suivre l'exécution de la transaction par l'intermédiaire des autorités du contrôle et de la modification unilatérale des termes de la transaction, afin de garantir que l'exécution de la transaction est conforme aux termes convenus, ainsi que d'exercer le pouvoir d'imposer des sanctions en cas de manquement ou de manquement de la part du contractant. Cela entraîne la résiliation du contrat, c'est-à-dire la résiliation de la relation contractuelle si le manquement est grave.
