جريمة الصرف في التشريع الجزائري

Résumé: تعد مخالفات تشريع الصرف من أهم و أخطر الجرائم التي تمس الدولة ،وتكمن خطورتها في المساس بالنظام الإقتصادي المنتهج ،وهذا الأخير هو مساس بمصالح الخزينة العامة ، مما استلزم لجوء المشرع الجزائري الى التصدي لهذا النوع من الإجرام بتجسيده لأحكام مناسبة لها. فالمشرع بعد أن ألغى تنظيم جريمة الصرف في قانون العقوبات وضع لها قانونا خاصا متمثل في الأمر رقم 96-22 المتعلق بقمع مخالفة التشريع وتنظيم الخاصين بالصرف وحركة رؤوس الأموال من والى الخارج ، المعدل والمتمم بموجب الأمر رقم 10-03 الذي يعتبر بمثابة أساس التنظيم وضبط هذه الجريمة بإحكام . ويتضمن هذا الأمر مجموعة من النصوص القانونية التي تميز هذه المخالفة عن الجرائم الأخرى من خلال إضفاء الطابع الخاص على أحكامها الموضوعية والإجرائية. Abstract: Violations of the currency exchange legislation are among the most important and dangerous crimes that affect the state. Their danger lies in undermining the established economic system, which, in turn, affects the interests of the public treasury. This necessitated the Algerian legislator to address this type of crime by enacting appropriate provisions. After abolishing the crime of currency exchange in the Penal Code, the legislator established a specific law to regulate and suppress violations of the legislation concerning currency exchange and the movement of capital to and from abroad. This law is represented by Order No. 96-22, as amended and supplemented by Order No. 10-03, which serves as the basis for regulating and controlling this crime effectively. This order includes a set of legal provisions that distinguish this violation from other crimes by providing specific and procedural provisions.
