معيارا المقامية والمقبولية وخطاب المشافهة في أصول الفقه: دراسة وصفية مقارنة
Résumé: يهدف هذا البحث إلى دراسة العلاقة بين معياري المقامية والمقبولية وبين خطاب المشافهة عند علماء أصول الفقه، وفق منهج وصفي مقارن، ابتدأناه بمقدمة ومبحثين نعرف فيهما المعيارين ومصطلح خطاب المشافهة، ثم درسنا مدى استحضار علماء أصول الفقه لمفهومي المقامية والمقبولية في بحثهم لقضية خطاب المشافهة؛ من خلال تعريفهم للخطاب، ومن خلال نظرية «أمية الشريعة» عند الشاطبي. The purpose of this research is to study the relationship between the criteria of Situationality and acceptability in text linguistics, and the issue of Khitab Almoshafaha in the science of Uṣūl al-fiqh, taking a comparative descriptive approach. We chose to have an introduction and a topic in the statement of the concept of Situationality and acceptability in text linguistics, And a second topic in the statement of the concept of Khitab Almoshafaha in the first sources of Uṣūl al-fiqh, and conclude with a study to show the extent of the scholars of Uṣūl al-fiqh to the meanings of situationality and acceptability in their search for the issue of Khitab Almoshafaha, Through their definition of speech, and through the theory of Al-Shatibi «illiteracy of Sharia».
