"مخطوط في أصول الفقه لابن سراقة العامري (ت410هـ): دراسة تحليلية" Manuscript On Foundations Of Jurisprudence By Ibn Suraqah Al-amiri: An Analytical Study

Résumé: ينتمي المقال إلى حقل الدراسات التراثية التي تهدف إلى إبراز مكنونات خزائن المخطوطات، وهذه الدراسة تحاول التعريف بمخطوط مغمور في علم أصول الفقه يعود تاريخ تدوينه إلى القرن الرابع الهجري، إثباتا لمؤلفه وتحليلا لمضمونه، مع بيان علاقة هذا الكتاب بما يسمى بكتاب "الأدلة والبيان" المنسوب إلى الشيخ تبغورين الملشوطي أحد أعلام إباضية الجزائر؛ وذلك من خلال الإجابة عن إشكالية المؤلف الأصلي لهذا الكتاب. ويتفرع عن ذلك: السؤال عن عنوان الكتاب؟ وعن منهج المؤلف فيه؟ ومن أجل التحقق من نسبة هذا المخطوط إلى أحد أعلام الشافعية؛ أوردت ما أمكن التوصل إليه من الدلائل والمؤيدات التي تفيد صحة هذه الفرضية، موظفًّا في ذلك منهجي المقارنة والتحليل، ومتَّبعًا قواعد منهج تحقيق المخطوطات. وقد أسفر البحث عن نتائج، أهمها: إثبات نسبة هذا الكتاب إلى ابن سراقة العامري، مع اقتراح صيغة لعنوانه، وكذا التوصية بتحقيق هذا المخطوط، بعد البحث عن نسخ أخرى له أكمل وأجود. Abstract : The article belongs to the field of heritage studies that aim to introduce the treasures of manuscripts. This study attempts to introduce an obscure manuscript in the science of jurisprudence whose authorship dates back to the fourth century AH, in order to prove its author and analyze its content. The research problem is the question about the original author of this book. From that, the question is about the title of the book, and about the author’s approach to it?. In order to verify the attribution of this manuscript to one of the Shafi’i scholars; I gathered as much evidence and support as possible that proves the validity of this hypothesis, employing the method of comparison and analysis, and following the rules of the manuscript investigation method. Among the important results of the research: Proving the attribution of this book to Ibn Suraqah Al-Amiri, with an approach to the title, as well as recommending the investigation this manuscript, after searching for other, more complete and better copies.
