معالم القانون الجمركي بين تصنيف الجريمة وأساليب المتابعة

Résumé: إن آليات مكافحة الجريمة كانت محطة جدل المفكرين ورجال القانون منذ القدم، و تعتبر الجريمة الجمركية من أخطر الجرائم التي تواجه أغلب دول العالم و تهدم اقتصادها و أمام التقدم الهائل للمجتمع في اﻟﻤﺠال الإقتصادي والتكنولوجي تطورت الأساليب الإجرامية باستعمال اﻟﻤﺠرمين تقنيات متطورة ووسائل جديدة في ارتكابها، مما أدى إلى اتساع نطاقها و قد انصب النقاش حول أساليب البحث والتحري عن الجريمة الجمركية وإثباﺗﻬا و معاقبة مرتكبيها وهو ما تطلب تدخل المشرع الجزائري في سن مجمــوعة مــن القواعـــد القانونيــة و التنظيمات للردع و التصدي لهذه الجريمة و أي مخالفة للإجــراءات القانونيــة يشكــل جريمة جمركية يعاقب عليهــا القانــون. الكلمات المفتاحية: الجريمة الجمركية، المحاضر الجمركية، المنازعات الجمركية، متابعة الجرائم الجمركية. Abstract: The mechanisms of combating crime have been the focus of controversy among thinkers and jurists since ancient times, and customs crime is considered one of the most dangerous crimes facing most countries of the world and destroying their economies. This led to the expansion of its scope and the discussion focused on the methods of searching and investigating customs crime, proving it and punishing its perpetrators, which required the intervention of the Algerian legislator in enacting a set of legal rules and regulations to deter and confront this crime. key words: Customs crime, customs records, customs disputes, follow-up to customs crimes.
