حقوق الانسان الرقمية في التشريعات المغاربية (الجزائر-تونس- المغرب) الحق في النفاذ الى المعلومة كنموذج

Résumé: كان للتطور المذهل في مجال التكنولوجيات الحديثة تأثيرا كبيرا على منظومة حقوق الإنسان التي أفرزت جيلا جديدا من حقوق الإنسان يمكن تسميته " بحقوق الإنسان الرقمية". من بين هذه الحقوق والحريات الرقمية الجديدة التي اعترفت بها الدساتير والتشريعات المغاربية نجد الحق في النفاذ إلى المعلومات، يعد هذا الحق حقا أساسيا من طائفة حقوق الإنسان الرقمية وجزء لا يتجزأ من حق إبداء الرأي وحرية التعبير والإعلام، وهو يكرس حق المواطن في الاطلاع على كافة المسائل التي تهمه، ومن ثم فهو يجسد ما يعبر عنه بـ " الديمقراطية التشاركية وحقوق المواطنة وتعزيز الحكم الراشد "، كما أن إعمال الحق في النفاذ إلى المعلومات يتطلب أيضا تعزيز ما بات يعرف ب " ديمقرطة الأنترنت " وفتح الشبكة العالمية أمام المواطنين وتكريس حق الولوج إليها والاستفادة من خدماتها، وممارسة حريات التعبير والرأي على منصات المواقع الإلكترونية، وعدم فرض قيود أو عقبات للدخول إليها، تكريسا لمنظومة حقوق الإنسان الرقمية والإلكترونية. Abstract: The great development of new technologies had a profound impact on the human rights system. This led to the adoption of a new generation of human rights called “digital human rights”. "The right of access to information" is among these new digital rights and freedoms recognized in the Maghreb Constitutions and Legislation, which is a fundamental right of all digital human rights and an integral part of the right to express opinions, freedom of expression and information. It enshrines the right of citizens to be informed of all matters affecting them, and thus embodies “the participatory democracy, citizenship rights and the promotion of good governance”. The realization of access to information right also requires the strengthening of what’s called "Internet democratization" and the opening of the global network to citizens by facilitating access to it and the use of its services. In addition to the exercise of freedom of expression and opinion on electronic platforms, without the imposition of restrictions or obstacles, in order to implement the digital human rights system.
