حق الإضراب و مبدأ استمرارية المرافق العامة في التشريع الجزائري، توافق أم تعارض؟

Résumé: حق الإضراب من الحقوق المعترف بها حديثا في ميدان العمل في أغلب دساتير الدّول بما فيها الجزائر. إلاّ أنّ هذا الحق، و رغم أهميته، يعرف حدوداً عندما يتعلق الأمر بالمصلحة العامة التي يُفترض أن يحترم فيها استمرارية المرافق العامة التي تسهر على تحقيقها و ضمانها. و من هنا نشأ صراع حول من له الأولوية: حق العمال في الإضراب و التوقف عن العمل للمطالبة بحقوقهم أم استمرارية المرافق العامة التي تحقق و تراعي المصلحة العامة لكافة المواطنين باعتبارها مبدئا دستوريا. و هنا يطرح السؤال هل يجب التضحية بأحدهما لأجل الآخر أم هناك إمكانية التوفيق بينهما؟ اختلفت بعض الدول في مسألة التوفيق بينهما، فهناك من يرجح أحدهما على الآخر. الا أن أغلب الدول اتخذت الحل الأوسط بفرض الحد الأدنى لنشاط المرفق في حالة الإضراب و هو ما عمل به المشرع الجزائري. The right to strike is a newly recognized in most constitutions of countries, including Algeria. However, this right defines limits when it comes to the public interest in which the continuity of the public facilities it ensures is supposed to be respected. From here a conflict arose over who has priority: the right of workers to strike or the continuity of public facilities. Here the question arises whether one should be sacrificed for the other or is there a possibility of reconciling them? Some States differed on the issue of reconciling them. There are those who favor one over the other. However, most countries have taken the solution by imposing the minimum activity of the facility in the strike, which is what the Algerian legislator did.
