ضمان حرية الاستثمار بين القيد والإطلاق في التشريع الجزائري

Résumé: من جملة الإصلاحات الاقتصادية التي تبناها المشرع الجزائري نجد تكريسه لمبدأ حرية الاستثمار الذي كان مقيدا في ظل الإيديولوجية الاشتراكية؛ حيث استحدث أجهزة مرنة لتأطيره وقدم ضمانات أخرى لتفعيله وحمايته. إلا أنه من الصعب الحديث فعليا عن حرية الاستثمار الأجنبي في الجزائر بسبب وجود بعض الضوابط والقيود التي تحد من هذه الحرية؛ كضابط النشاطات والمهن المقننة وضابط حماية البيئة، أما القيود فنجد قيد الاعتماد المسبق وقاعدة الشراكة وحق الشفعة والتي من شأنها التأثير في حجم الاستثمارات المستقطبة.
