مخالفة ما جرى به العمل للقول المشهور عند المالكية دراسة تطبيقية في مجال الطهارة

Résumé: الملخص: يعد ما جرى به العمل من أهم القواعد الفقهية في المذهب المالكي، لذلك عدل فقهاء المالكية عن القول الراجح أو المشهور، واختاروا القول الضعيف وأفتوا به، لسبب موجب رجحانه، من أجل تحقيق جلب المصالح ودرء المفاسد ورعي الأعراف، فيتعين اتباعه، ويقدم على القول الراجح أو المشهور، إذا توفرت فيه الشروط، واستند إلى دليل شرعي، وذلك وفق أصول المذهب وقواعده، لا بمجرد الهوى، وخصوصا في المجال التطبيقي في فن الطهارة. Summary: What was done with the work is considered one of the most important rules of jurisprudence in the maliki school of thought. Therefore, maliki jurists have modified the most correct or well- known saying, and have chosen the weak saying and fulfilled it, for a reason that is preponderant, in order to achieve the attainment of interests, ward off evil and take care of norms. Or the well-known, if the conditions are met, and it is based on legal evidence, according to the origins and rules of the doctrine, not just whimsical, especially in the applied field in the art of purity.
