ضمان التوقف عن الدفع المصرفي

Résumé: أي خلل يمس باستقرار القطاع المصرفي من شأنه أن يؤثر على الاقتصاد ككل، ينشأ هذا الأخير عادة من المخاطر التي تواجه العمل المصرفي والتي من شأنها أن تسبب في تعثر المؤسسة المصرفية وتوقفها عن الدفع. ونظرا لترابط المصارف مع بعضها قد يؤدي إفلاس أحدها إلى إحداث هزة مصرفية. كان أمام حرص السلطات على ضمان الثقة بالقطاع المصرفي الذي يواجه احتمالات التعرض لأزمات مالية مفاجئة قد تؤثر على حقوق المودعين، ابتكار نظام التأمين على الودائع كآلية جديدة غير مألوف في القواعد العامة، يهدف إلى ضمان حماية خاصة لأموال المودعين من المخاطر التي قد تتعرض لها المؤسسة المصرفية وتجعلها في وضعية التوقف عن الدفع، وذلك بالتكفل بتعويضهم، بناءا على إلزامية المصارف بدفع اشتراكات سنوية مقدرة. Any imbalance affecting the stability of the banking sector would affect the economy as a whole, and this imbalance generally stems from the risks faced by banking activity, which can cause banking to falter and stop paying. Thus, faced with the desire of the authorities to ensure confidence in the banking sector, which faces the possibility of sudden financial crises that may affect depositors' rights, the deposit insurance system has been conceived as a new mechanism unknown in the general rules, aimed at ensuring special protection of depositors' funds from the risks to which the bank may be exposed and putting it in a stop-payment position , by insuring compensation, on the basis of the mandatory payment of annual contributions estimated by banks.
