اهتمام المصادر الأوروبية بالقضاء في الجزائر العثمانية خلال القرن 18 وأوائل القرن 19 م

Résumé: لعبت مؤسسة القضاء دورا فعالا في تثبيت النظام، و محاربة الانحرافات الخلقية، والسلوكيات الإجرامية بين أفراد المجتمع الجزائري خلال القرنين 18و19 للميلاد، ولعل الفضل يعود في ذلك إلى الجهود المبذولة من طرف موظفي هذا السلك، وسهرهم على تطبيق القوانين، وتجسيد قيم العدالة بين مختلف شرائح المجتمع دون استثناء، وقد وضعت السلطة الحاكمة هي الأخرى في سبيل هذه الغاية، نظاما قضائيا محكما يتماشى مع التركيبة الاجتماعية السائدة آنذاك، والتي كانت تضم خليطا من الأجناس المختلفة (أتراك، عرب، يهود، مسيحيين وأوروبيين..الخ)، فظهرت محاكم قضائية مالكية خاصة بالسكان المحليين، وأخرى حنفية خاصة بالأتراك بالإضافة إلى قضاء أهل الذمة من يهود ومسيحيين، والقضاء الخاص بالجماعة...الخ. وقد تركت لنا المصادر الأوروبية المعاصرة لهذه الفترة، والمتمثلة في الكتب والمذكرات التي ألفها كل من الأسرى، الجواسيس، القناصل، الرحالة، رجال الدين... الخ، ممن زاروا الجزائر ، مادة تاريخية هامة حول موضوع القضاء، تمكن الباحث في تاريخ الجزائر العثماني من خلال التنقيب فيها بعرض دراسة متعلقة بالموضوع المذكور آنفا، وهذا ما تهدف إليه دراستنا، والتي حاولنا فيها تسليط الضوء على القضاء الجزائري خلال القرنين 18 و19للميلاد، وفق المنظور الأوروبي من خلال عرضنا لما سجله هؤلاء الأوروبيون، من ملاحظات ومعلومات وأوصاف، متعلقة بأنواع المحاكم القضائية الموجودة آنذاك وموظفيها وأشكال العقوبات المطبقة فيها،معتمدين في ذلك على المنهج التاريخي الوصفي والتحليلي. . The Judiciary institution played an effective role in establishing order and fighting moral deviations and criminal behaviours among the members of the Algerian community during the 18th and 19th centuries. This was thanks to the efforts made by the employees of this corps, their watchfulness in applying the laws, and embodying the values of justice among the various segments of society without exception. For this purpose, the ruling authority has also established a tight judicial system in line with the prevailing social structure at the time, which used to include a mixture of different races (Turks, Arabs, Jews, European Christians, etc.). Hence, Royal Courts of the local population appeared, and others Hanafi for the Turks, in addition to the Judgment of the Dhimmis, from the Jews and Christians, and the special court of the group ... etc. The contemporary European sources for this period left us the books and memos written by the prisoners, spies, consuls, nomads, clerics, etc. Those who visited Algeria met an important historical article related to the issue of the judiciary, which the researcher in the Ottoman history of Algeria can explore through the opinions of these Europeans on the aforementioned subject, and this is what is aimed in our study, as we try to shed light on the judiciary system during the 18th and 19th centuries, according to the European perspective, through our presentation of the notes recorded by the owners of these sources, notes, information and descriptions related to the types of judicial courts that existed at the time and their employees and the forms of penalties applied in them, in which a historical descriptive and analytical approach was adopted.
