مراعاة الخلاف عند المالكية وتطبيقاته في باب المعاملات: دراسة تأصيلية نموذجية

Résumé: يهدف هذا البحث إلى بيان أهمية أصل مراعاة الخلاف ومنزلته بين أصول المذهب المالكي، وجمع بعض الفروع الفقهية المندرجة تحته في باب المعاملات، سواء ما تعلق منها بفقه الأسرة أو فقه المعاملات المالية، بحيث تظهر مرونة الفقه المالكي في مراعاة دليل المخالف أحيانا لأجل تصحيح بعض التصرفات الصادرة من المكلف، خدمةً لمصلحته ودفعاً للضرر عنه، وإن خالف ذلك أصول المذهب القاضية ببطلان ذلك التصرف. Abstract: The purpose of this research is to show the importance of respect for the other opinion and its rank among the principles of the Maliki doctrine. It also aims to collect some of the jurisprudence’s sections thereunder concerning both family and financial transactions. Therefore the flexibility of Al-Maliki doctrine appears in respecting the other opinion sometimes to validate some designated acts in order to sustain his interest and push away the damage from him even if this was contrary to the assets of the doctrine judging the invalidity of that act.
