جريمة الإختلاس في ظل قانون مكافحة الفساد

Résumé: اقتضت الدراسة تناول الاجراءات المتبعة التي خصها المشرع الجزائري فيما يخص جريمة الاختلاس، بحيث قام بتجميد أملاك والأموال والعائدات الغير مشروعة المسلوبة بغير وجه حق من أصحابها، وكما قام أيضا بتوسيع نطاق الخاص بتحريك الدعوى العمومية الذي يعد قد تطور عما كان من قبل، ونرى أن التقادم الخاص بهذه الجريمة قد قام بتجنيحها وأقر لها مدة أطول من مدة التقادم الخاص بمواد الجنح. وقد بينا من خلال ما قدمناه في العرض أن جريمة الاختلاس لها خطورة على عدة مستويات وخاصة منها على مستوى المؤسسات العامة والخاصة طبقا للقانون 06-01 المتعلق بوقاية من الفساد ومكافحته بعدما أخضعها المنظمة التشريعية تحت رايتها متتبعة في ذلك التشريعات الدولية. الكلمات المفتاحية: الاختلاس، المشرع الجزائري، الأموال، جرائم، الفساد، المنظمة.The study necessitated addressing the procedures followed by the Algerian legislator with regard to the crime of embezzlement, as he has frozen illegal property, money and proceeds illegally stolen from their owners, and he has also expanded the scope of the public prosecution, which is considered to have evolved from what was before, and we see that the statute of limitations The person concerned with this crime has misled her and approved for her a period longer than the limitation period for the articles of misdemeanour.
