مصلحة المحضون في قانون الأسرة الجزائري ودورها في حماية الطفل

Résumé: ملخص: باعتبار أن الحضانة أثر من آثار فك الرابطة الزوجية، وتقوم على تحقيق الحماية لطفل المحضون لكونه الحلقة الأضعف في هذه المرحلة، وذلك بتقديم له الرعاية المعنوية والروحية، والرعاية المادية من نفقة لتغطية احتياجاته، ومسكن ملائم لإيوائه، وهذه الغاية المراد تحقيقها أطلق عليها الفقهاء بمصلحة الطفل المحضون. ارتأينا في هذه المداخلة الى تسليط الضوء على هذه المصلحة في قانون الأسرة الجزائري ، حيث حظيت باهتمام كبير من قبل المشرع الجزائري في التعديلات التي أدخلها على قانون الأسرة سنة 2005، فأصبحت كل المسائل المتعلقة بالحضانة لا تخلو من المراعاة لمصلحة الطفل المحضون، وذلك ما التمسناه في القرارات القضائية خلال تطبيق وتفسير تلك النصوص القانونية. Abstract : Custody is considered among the most significant outcomes of ending a marriage, and it is based on the rationale of protecting the child, who is the weakest link at this stage, by giving them moral and spiritual care, as well as material care, such as alimony to cover their needs and adequate housing to accommodate them. Judges called this objective to be met in the foster child's best interests. On this basis, the present research paper aims to shed light on this interest in Algerian Family Law, as it received great attention from the Algerian legislator in the amendments he introduced to Family Law in 2005 so that all issues related to custody are not devoid of consideration for the interest of the child in custody, and that is what we sought in Judicial decisions during the application and interpretation of these legal texts
