استدامة النسيج العمراني القديم في التشريع الجزائري

Résumé: يعد التراث مرآة لثقافة المجتمع، حيث يعبر عن جذوره الحضارية وهويته الثقافية، ومن هذا المنطلق وجب الاهتمام بهذا التراث فكريا وتنمويا، والجزائر كغيرها من بلدان العالم تزخر بمعالم ونماذج عمرانية ذات خصوصيات تختلف من منطقة لأخرى من حيث الطابع العمراني والمعماري ،حيث شهدت هذه المجالات، خاصة الأنوية العمرانية التاريخية لمعظم المدن العتيقة تغيرات وتحولات جوهرية: وظيفيا بفقدانها لنشاطاتها الاقتصادية، عمرانيا بتدهور بنايتها وباستحداث طرق جديدة للتعمير والبناء. هذا ما جعل هذه المجالات تعاني من أزمات ومشاكل أصبحت تهدد التناسق العمراني، الوظيفي والاجتماعي، الأمر الذي أجبر السلطات على التفكير في الحلول المناسبة من خلال بعث مشاريع عمرانية تتناسب وتتماشى وتلك التحولات بتجسيد البرنامج الوطني لإعادة الاعتبار و تأهيل هذه المباني خلال المخطط الخماسي 2015/2019 التي تلاها مباشرة صدور المرسوم التنفيذي محور دراستنا المحدد لشروط و كيفيات التدخل في الأنسجة العمرانية القديمة رقم 16 / 55 المؤرخ في 01 فيفري 2016 ، وقد ضبط المشرع الهيئات و الإجراءات اللازمة لتجسيد و تنفيذ عملية التدخل في النسيج العمراني القديم. : Heritage is a mirror of the culture of society, as it expresses its cultural roots and cultural identity. From this standpoint, attention must be paid to this heritage intellectually and developmentally. Especially the historical urban nuclei of most of the ancient cities, fundamental changes and transformations: functionally with the loss of its economic activities, urbanly with the deterioration of its buildings and with the introduction of new methods of reconstruction and construction. This is what caused these areas to suffer from crises and problems that have become threatening the urban, functional and social harmony, which forced the authorities to think about appropriate solutions by launching urban projects commensurate and in line with these transformations by embodying the national program for the rehabilitation and rehabilitation of these buildings during the five-year plan 2015/2019 Which was immediately followed by the issuance of the Executive Decree, the focus of our study specifying the conditions and modalities for intervention in the old urban fabric No. 16/55 of February 01, 2016, and the legislator set the bodies and procedures necessary to embody and implement the process of intervention in the old urban fabric.
