النطاق القانوني للجزاء الإجرائي في الخصومة المدنية

Résumé: ملخص : بما أن القاعدة القانونية الإجرائية هي قاعدة ملزمة فإنها تحتوی على جزاءات اجرائية،و الجزاء الاجرائي بأنه الأثر القانوني المترتب على مخالفة العمل الإجرائي للنموذج القانوني الذي تحدده القاعدة الاجرائية، وتؤدي إلى عدم توليد هذا العمل الآثار التي كان يولدها لو نشأ صحيحا وتفرضه احدى الجهات القضائية ،فالعمل الإجرائي يكون صحيحا ومنتجا لأثاره القانونية اذا استوفي الشروط اللازمة لصحته سواء كانت شكلية أم موضوعية اما اذا تخلف فيه شرط من الشروط فأنه يعد مخالفا للقانون ويخرج من دائرة الأعمال الإجرائية الصحيحة ليندرج تحت الأعمال الإجرائية المعيبة مما يقضي فرض أحد الجزاءات الإجرائية على مثل هذه الأعمال وهي تختلف باختلاف العيوب التي يمكن أن تصيب العمل الإجرائي Abstract: Since the procedural legal rule is a binding rule, it is subject to procedural sanctions and procedural penalties as the legal effect of a procedural violation of the legal model established by the procedural rule and does not result in the effects it would have generated had it been properly established and imposed by a judicial authority, Procedural work is valid and produces its legal effects if it fulfills the necessary conditions for its validity, whether formal or objective.
