حماية البيئة في ظل قواعد الملكية العمومية

Résumé: تستهدف هذه الدراسة تحديد الحماية القانونية التي توفرها قواعد الملكية العمومية للبيئة ، وهو ما اقتضى منا تحديد العلاقة الوطيدة التي تربط بين الأملاك العامة الطبيعية و المكونات والعناصر البيئية ومن ثم ترتيب الآثار القانونية على هذه العلاقة لصالح حماية البيئة وهوما تجلى لنا فيما يخص الإدراج في ملكية العمومية الطبيعية أو فيما يخص تطبيق قواعد الحماية والتسيير . ولكن تظل هذه الحماية تتميز بالمحدودية سواء فيما يخص نطاقها أو مضمونها. This study aims to determine the legal. protection provided by the rules of public ownership of the environment, which required us to define the close relationship between natural public property and the environment, and then arrange the legal effects on this relationship in favor of protecting the environment, which was evident to us with regard to inclusion in natural public ownership or regarding Concerning the application of protection and management rules. However, this protection remains limited, both in terms of its scope and content.
