الجرائم الماسة بالأشخاص عبر الأنترنت في القانون الجزائري

Résumé: مرت الجريمة الالكترونية بمراحل تاريخية مختلفة فوصلت إلى درجة عالية من التطور، وذلك بتطور التكنولوجيا والثورة العلمية مما صعب على التشريعات إيجاد مفهوم متفق عليه، حيث تعددت التعاريف ولكنها لم تختلف عن التصدي لها ، أما بالنسبة للمشرع الجزائري فقد تطرق إلى تعريف الجريمة الالكترونية مسميا إياها بجريمة المساس بأنظمة المعالجة الآلية للمعطيات. لا تختلف أركان هذه الجريمة عن أركان الجريمة التقليدية المعروفة، والتي تتمثل في الركن الشرعي والركن المادي والركن المعنوي. لم يكتفي المشرع الجزائري بتجريم الأعمال الالكترونية عبر الانترنت في القوانين الخاصة والعامة، بل استحدث طرقا جديدة تخص إجراءات البحث والتحري في الجرائم الماسة بالأشخاص عبر الأنترنت. الكلمات المفتاحية: الجرائم الماسة بالأشخاص- الجريمة الالكترونية- إجراءات البحث والتحري.
