تحديد مسؤولية المقاول الفردي: دراسة مقارنة بين التشريعين الجزائري والفرنسي

Résumé: لتحديد مسؤولية المقاول الفردي، كرّس المشرعين الفرنسي والجزائري، في القانون التجاري، آليات قانونية، تتمثل الأولى في نظام "المؤسسة ذات الشخص الوحيد وذات المسؤولية المحدودة"EURL، وتتمثل الثانية في نظام "المقاول الفردي ذو المسؤولية المحدودة"EIRL فالآلية الأولى معروفة في القانون الجزائري منذ صدور الأمر رقم 96 -27، وفي القانون الفرنسي عُرفت منذ صدور تشريع 85 – 697، والآلية الثانية كرسها فقط المشرع الفرنسي بموجب تشريع 2010 -658، غير أن فكرة تحديد المسؤولية فكرة نسبية، بحيث أثبتت الدراسة أن المقاول الفردي غالبا ما يكون مسؤولا مسؤولية مطلقة، في حالات معينة، في ظل النظامين السالفي الذكر. To limiting the responsibility of the individual entrepreneur, the French and Algerian legislators have devoted, in commercial law, legal mechanisms, the first of which is the system of “EURL; the individual limited liability company ”, and the second is the system of the “EIRL; individual entrepreneur with limited liability” EURL is known in Algerian law Since the issuance of Ordinance No. 96-27, and in French law since the promulgation of Legislation 85-697, the second mechanism has been devoted only to the French legislator according to the 2010-658 Legislation, however the idea of assigning responsibility is a relative idea, so that the study demonstrated that the individual contractor is often fully responsible, In certain cases, under the shadow Two systems mentioned above .
